Constitutional Framework

  • Articles 233 to 237 in Part VI deal with the subordinate judiciary.

  • Subordinate courts function below the High Court at the district and lower levels.

  • Their organisation, jurisdiction and nomenclature are largely determined by the States, so the institutional structure varies across States.

  • The constitutional framework primarily seeks to regulate:

    • appointment of district judges;
    • recruitment to State judicial service;
    • High Court control over subordinate courts;
    • interpretation of terms relating to the subordinate judiciary;
    • application of these provisions to specified magistrates.
