Constitutional Position of Union Territories

  • Union Territories are governed under Part VIII of the Constitution, primarily through Articles 239-241.

  • Under Article 1, the territory of India comprises:

    • territories of the States;
    • Union Territories; and
    • territories that may be acquired by India.
  • Unlike States, Union Territories are administered primarily under the authority of the Union Government.

  • Every Union Territory is administered by an Administrator appointed by the President under Article 239.

  • The Administrator is constitutionally an agent of the President, unlike a State Governor who functions as the constitutional head of a State.
